Bengaluru: Kannada superstar Yash’s much-awaited film ‘Toxic: A Fairy Tale for Grown-Ups’ has received interim legal protection from a Bengaluru court ahead of its release.
The Additional City Civil and Sessions Court in Bengaluru has passed an ex-parte temporary injunction restraining defendants, including unknown persons, from publishing, circulating, sharing, posting or streaming false, malicious, defamatory or derogatory content concerning the film.
The order was passed in a lawsuit filed by the film’s production company, KVN Productions LLP.
Court Issues John Doe Order
One of the key aspects of the case is the John Doe Order issued against unidentified persons.
Such orders can be sought when the identities of potential infringers or persons posing a threat are not known at the time of filing the case. In the Toxic matter, the court’s order extends beyond specifically named defendants and covers unknown persons as well.
The court referred to the Karnataka High Court’s decision in Meera Ajith v. John Doe @ Ashok Kumar, which recognised that an injunction against unknown persons can be granted where a genuine threat is demonstrated and a prima facie case is established.
What Has the Court Restricted?
The interim order covers communication, publication, circulation, sharing, posting, streaming, providing access to or otherwise communicating through any form of media material concerning Toxic that is false, malicious, defamatory or derogatory.
The order applies to such material both before and after the film’s release.
Court Finds Prima Facie Case in Favour of Producers
The court considered the documents submitted by KVN Productions and found a prima facie case in favour of the plaintiff-producer.
It also held that the balance of convenience was in favour of the producer. According to the court, refusing interim protection could defeat the purpose of the lawsuit and potentially lead to multiple proceedings.
Injunction Effective Until September 28
The interim injunction is currently limited to the next date of hearing.
The matter is scheduled to come up before the court on September 28, 2026. The court has also clarified that the order cannot be used for any purpose other than the purpose for which it has been granted.
Case Filed by KVN Productions LLP
The producer has sought interim relief under Order 39 Rules 1 and 2 of the Code of Civil Procedure (CPC) against several defendants, including unidentified persons.
The case is titled KVN Productions LLP v. X Corp & Ors. and has been registered as O.S./0006026/2026.
